Terms of Service
Please read these Terms of Service carefully before using Artho – Your Money, Your Meaning. These Terms govern your access to and use of our application and services. By using Artho, you agree to be bound by these Terms.
1. Acceptance of Terms
- By downloading, installing, accessing, or using Artho – Your Money, Your Meaning ('App', 'Service'), you ('User', 'you') agree to be legally bound by these Terms of Service ('Terms').
- If you do not agree to these Terms, you must not download, access, or use the application.
- These Terms form a legally binding agreement between you and Hari Sharan Subedi, the individual developer of Artho ('we', 'us', 'our'), operating from Nepal.
- Your use of Artho is also governed by our Privacy Policy (available within the app and on our website), which is incorporated into these Terms by reference. Please read the Privacy Policy carefully.
- We reserve the right to update these Terms at any time. We will notify you of material changes via in-app notice at least 14 days before they take effect. Your continued use of the app after the effective date constitutes acceptance of the revised Terms.
- If you are using this app on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
- Artho is a personal financial management application designed to help individuals track income, expenses, salary, overtime, pay & due records, assets, stock journal entries, split expenses (Splitwise), international remittance, insurance policies, financial goals, financial health metrics, and monthly money story reports. The app also provides a Financial Calendar for upcoming payments and milestones, and an AI Financial Coach for data-driven insights.
- The Service is provided for personal, non-commercial use only. Use of the Service for business, commercial, or professional financial advisory purposes is not permitted under these Terms.
- Artho is an informational tool only. It does not provide licensed financial advice, investment recommendations, tax advice, or legal counsel. All financial decisions should be made in consultation with qualified professionals.
- We provide the Service 'as is' and 'as available' without any warranty that the Service will be uninterrupted, error-free, or free from inaccuracies.
- Features, functionality, and availability of the Service may change at any time. We may add, modify, or discontinue features with or without prior notice.
- Access to certain features may require creating an account. You must provide accurate and complete information when registering.
3. Eligibility & Account Registration
- You must be at least 13 years of age to use Artho. Users in the European Union must be at least 16 years old, or the minimum age required by the law of their country.
- By using the app, you represent and warrant that you meet the minimum age requirement applicable in your jurisdiction.
- You are responsible for maintaining the confidentiality of your account credentials (email, password, or linked Google account) and for all activities that occur under your account.
- You must notify us immediately at support.artho@gmail.com if you suspect unauthorized access to your account.
- You may not create more than one account per person. Duplicate accounts may be suspended without notice.
- You agree to provide accurate, current, and complete information during registration and to keep your profile information up to date.
4. User Responsibilities & Acceptable Use
- You are solely responsible for the accuracy, completeness, and legality of all data you enter into the app, including financial figures, records, and personal information.
- You agree not to use Artho for any unlawful, fraudulent, deceptive, or harmful purpose.
- You must not attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the application.
- You must not use the application to store, transmit, or distribute malware, viruses, ransomware, or any other harmful or malicious code.
- You must not attempt to gain unauthorized access to any part of the service, its servers, databases, or related systems.
- You must not interfere with, disrupt, or create an undue burden on the servers or networks connected to the service.
- You must not use any automated scraping, crawling, or data extraction tools against the service.
- You must not impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Violation of these acceptable use requirements may result in immediate account suspension or termination without notice.
5. User Content & Data Ownership
- You retain full ownership of all financial data and personal information you input into Artho. We do not claim ownership of your data.
- By using the Service, you grant us a limited, non-exclusive, royalty-free license to store, process, and use your data solely to provide the Service as described in our Privacy Policy.
- We will never sell your financial data to third parties for advertising, marketing, or profiling purposes.
- You are responsible for ensuring your data is accurate and that you have the legal right to input and store that data in the app.
- You acknowledge that the financial insights, reports, and calculations generated by the app are based entirely on the data you provide, and their accuracy depends on the quality of your inputs.
- You can export, modify, or delete your data at any time. See the Privacy Policy for details on data deletion.
6. Intellectual Property
- Artho, including its name, logo, design, source code, features, and all content created by us, is the exclusive intellectual property of Hari Sharan Subedi and is protected by copyright, trademark, and other applicable intellectual property laws.
- These Terms do not transfer any intellectual property rights to you. You are granted only a limited, non-exclusive, non-transferable, revocable license to use the app for its intended personal purpose.
- You may not copy, reproduce, distribute, publish, create derivative works from, or commercially exploit any part of the app without our prior written consent.
- Any feedback, suggestions, or ideas you provide about the app may be used by us without any obligation to compensate you.
- Third-party libraries and services used within the app are subject to their respective licenses and terms.
7. Payments & Subscriptions
- Artho is currently available as a free application. Certain premium features may be introduced in the future under a paid subscription or one-time purchase model.
- Any paid features or subscriptions will be processed exclusively through Google Play Billing (Android) or Apple In-App Purchase (iOS) using secure payment infrastructure provided by the respective platform.
- We do not directly collect or store your credit card or payment information.
- Subscription fees will be charged on a recurring basis (monthly or annually as specified) until you cancel. You can manage or cancel subscriptions through your Google Play or App Store account settings.
- All fees are non-refundable except as required by applicable law or as specified in our refund policy at the time of purchase.
- We reserve the right to change pricing with at least 30 days' prior notice to existing subscribers. Price changes will take effect at the start of the next billing cycle.
- Free features will continue to be available at no charge unless stated otherwise.
8. Prohibited Uses
- Money Laundering: You may not use Artho to record, track, or facilitate money laundering, tax evasion, or any other financial crime.
- False Records: You may not use the app to create false or misleading financial records intended to deceive any person, institution, or government authority.
- Unauthorized Access: You may not attempt to access other users' accounts, data, or any non-public areas of our systems.
- Automated Abuse: You may not use bots, scrapers, or automated tools to interact with the app in any way not explicitly permitted.
- Commercial Resale: You may not resell, sublicense, or offer the service as part of a commercial product without our written consent.
- Harmful Content: You may not upload or transmit any content that is illegal, defamatory, threatening, or infringes on any third party's rights.
9. Disclaimers & Limitation of Liability
- Artho is provided 'as is' without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We do not warrant that the app will be available at all times, error-free, or that any defects will be corrected.
- Artho is a personal finance tracking tool and does NOT constitute professional financial, investment, tax, accounting, or legal advice. You should always consult a qualified professional before making financial decisions.
- We are not responsible for any financial losses, missed payments, incorrect tax filings, or other outcomes resulting from your reliance on data displayed in the app.
- We do not guarantee the accuracy of currency exchange rates, tax rates, or regional financial data displayed in the app, as these may be outdated or region-specific.
- To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months prior to the claim or (b) NPR 1,000 (Nepalese Rupees).
- We shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, even if we have been advised of the possibility of such damages.
10. Indemnification
- You agree to indemnify, defend, and hold harmless Hari Sharan Subedi (developer of Artho), and any affiliated individuals or entities, from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- (a) Your use or misuse of the Service;
- (b) Your violation of these Terms or our Privacy Policy;
- (c) Your violation of any applicable law or regulation;
- (d) Your infringement of any third-party right, including intellectual property rights or privacy rights;
- (e) Any content or data you submit to the Service.
- We reserve the right to assume exclusive control of the defense of any matter subject to indemnification by you, in which case you agree to cooperate with us at your expense.
11. Termination
- You may terminate your account at any time by using the 'Delete Account' option in the app (Settings → Delete Account) or by contacting us at support.artho@gmail.com.
- We reserve the right to suspend or permanently terminate your account, without notice, if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law.
- Upon termination, your license to use the app immediately ceases. You must stop using the app and uninstall it from your devices.
- Account deletion results in permanent loss of your data. We recommend exporting your financial reports before deleting your account.
- Provisions of these Terms that by their nature should survive termination (including ownership, disclaimers, indemnification, and dispute resolution) will remain in effect after termination.
- We may also suspend or terminate the entire Service at any time. In such an event, we will provide reasonable advance notice where possible.
12. Force Majeure
- We shall not be held liable for any failure or delay in performance of our obligations under these Terms where such failure or delay is due to circumstances beyond our reasonable control.
- This includes but is not limited to: natural disasters, acts of government, internet outages, third-party service failures (including Google/Firebase outages), power failures, civil unrest, pandemic events, or any other force majeure event.
- In such circumstances, we will make reasonable efforts to restore the Service as soon as practicable.
13. Dispute Resolution & Governing Law
- These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to conflict of law principles.
- In the event of any dispute arising from or relating to these Terms or the Service, the parties agree to first attempt resolution through good-faith negotiation by contacting us at support.artho@gmail.com.
- If the dispute cannot be resolved through negotiation within 30 days, it shall be referred to binding arbitration conducted in Kathmandu, Nepal under the applicable arbitration rules.
- Notwithstanding the above, either party may seek injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm.
- You agree that any dispute resolution proceedings will be conducted on an individual basis only, and not in a class, consolidated, or representative action.
- The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply to these Terms.
- If any provision of these Terms is found to be unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
14. Google Play Store Compliance
- By using the Android version of Artho distributed through Google Play, you also agree to Google Play's Terms of Service.
- Artho complies with Google Play's Developer Program Policies, including the User Data Policy, Payments Policy, and Families Policy.
- In the event of a conflict between these Terms and Google Play's Terms of Service, Google Play's Terms shall prevail with respect to your use of Google Play.
- Artho's Data Safety declaration in the Google Play Store accurately reflects data collection and sharing practices as described in our Privacy Policy.
- Any disputes related to app distribution or purchases made through Google Play are subject to Google's policies and terms.

All financial calculations, projections, and reports generated by the app are based solely on data you enter. Always consult a qualified financial advisor, accountant, or legal professional before making significant financial decisions. We are not responsible for any financial outcomes arising from your use of this application.
